Police Release 911 Tape Reporting Duluth Shooting

Woman shot, killed intruder who confronted her with knife in her home as she exited shower.

 

Gwinnett Police have released a recording of the 911 call made by a Duluth woman after she shot the knife-wielding intruder who attacked her at home last Wednesday (May 11). Her assailant, identified by police as Israel Perez Puentes, 34, of Alpharetta, died later from the gunshot wounds.

The incident occurred about 6:30 a.m. when Punetes entered the home in the 2800 block of East Mount Tabor Circle in unincorporated Duluth, as the resident, a 53-year-old woman, was coming out of the shower, according to a Gwinnett Police spokesman. "She was exiting the shower when the man wielding a [kitchen] knife entered her bathroom," said Gwinnett Police spokesman Cpl. Edwin Ritter.

The woman tried to fight off the man with the shower rod after she had fallen into the bathtub. Her attacker then forced her into the bedroom. Puentes apparently was going to sexually assault her, Ritter said. She was able to retrieve her .22-caliber pistol and then shot him multiple times, according to Ritter. Puentes left the house through the rear door and collapsed in the backyard.

A neighbor to whose home the woman had run after the attack placed the 911 call then put her on the telephone. Sobbing hysterically, she managed to tell the dispatcher about the attack and give her address.

“I was in the shower and the lights cut out in my house, and a man came in with a hood, and he had a knife in his hand….He told me to be quiet. He told me to get out of the tub, and he tried to force me on(to) the bed,” the woman told the police dispatcher.  

The woman was able to retrieve a .22 caliber pistol that she kept in a nightstand near the bed. “I took my .22, and I shot him as much as I could.” The woman informed the dispatcher she locked the rear sliding glass door after he ran out, and she rushed out the front door to the neighbor’s house. She said she wasn’t sure of his whereabouts.

Puentes was transported to Gwinnett Medical Center in Lawrenceville where he later died from his injuries. The woman was transported to Gwinnett Medical Center in Duluth and was treated for minor injuries, Ritter said. No charges are expected to be filed against the woman. “It was apparently a justified use of deadly force," he said.

For this exact reason everyone should teach themselves some form of self defense!! God bless you girl for what you did and the example you made of that scumbag! Everyone should let these worthless types of people who do this kind of thing to women and crime in general know and truely see that we've had enough!!! As if we don't have enough burden in life between taxes, raising prices on everything, politicians not doing a damn thing for us and budgets being cut for everything including the would be defenders who protect us against situations like these! Now's the time people,,,,,not AFTER SOMETHING BAD HAPPENS!! Know that the best defense is a good, well planned and prepared offense! If we were to pull together, as a community/neighbors we could defeat any and all opposition. Don't let something like what unfortunately happened to this poor woman be the reason why and how you first get to know your neighbors!! Sorry, Ben, but it's not "neat". I have no problems with this woman defending herself. She did the right thing. But to say that anyone can go into a store and buy a hand gun without any backround check is irresponsible. If you have a clean record and have no mental health issues then you have nothing to worry about, right? So why are all this supposedly upstanding citizens against any kind of regulation? I have friends who have a virtual arsenal in their home, they are collectors, and they have no problem with backround checks and registration. Why? Because they don't have anything to hide or worry about. I know, I know...the criminals will get guns anyway...blah blah blah...but why should we make it easy for them? We register our cars, boats, our dogs and in some places you even need a license to go fishing, but a gun, who's sole purpose it to kill or injure another living thing, should be exempt? That's nuts, not "neat".

It is not really the size of the gun. Each person should have a gun they can handle and then learn to handle it well. The nice part about a .22 is it bounces around inside and tears the perp up, also, less blood to clean up.

Wonderful.. Sorry it had to be you ma'am, to shoot this piece of "you know what", but more and more women need to have a pistol loaded and ready to shoot. It is a valuable aide to protect a person in their home. You live alone gals, get a good caliber pistol and learn how to use it !
There are many homes with a pistol at the ready whether in a nightstand or other close location. It will stop an intruder much faster however if you get a little larger caliber. GOOD FOR YOU. YOU saved yourself from untold long lasting psycological treatment by pulling the trigger. I know you feel bad, but you would have had a life time of scarred living. You'll get over this much easier.

Sarah, if you really want to buy a firearm, be sure to take some instruction and range time so that you know how to properly use one, and gain experience in how ot works, and what to expect when it fires. There are courses available that can teach you the law as it applies to use of deadly force. I cant stress enough the importance of learning these things.

I'll never forget going to a cocktail party at my boss's house & learning, later, about my husband's convervation with him. My boss lived in a prestigious community on Griffin Gate Golf Course. Somehow their conversation about their shared love of golf turned to other manly pursuits--shooting guns rather than golf balls. My boss apparently was "put off" by my husband's revealing that he owned guns, loaded guns. My boss, with a tinge of disdain, disapproval & condescension, said, "You have guns?!" My husband's priceless reply? "You mean, you DON'T!!!????" Nowadays, one must be woefully uninformed to remain unarmed. Even little ol' Lexington, in the Heart of the Beautiful Bluegrass, has regular home invasions. We're ready!!! By the way, excellent advice to Sarah above. Get a gun, get educated & get trained. I know when I carry a gun I don't feel powerful. I just feel very, very safe. It's a good feeling. By the way, in my youth in the Chicago area, I was targeted multiple times by rapists & stalkers. By the grace of God I always managed to escape. That was 40 years ago. I cannot imagine how bad the crime rate is up there now. Learned that a few years ago Chicago received the dubious distinction of overtaking Detroit as the Murder Capital of Ameria. Sad. Be smart. Get armed. And always follow gun safety rules--especially if you have children in the house or even visiting grandchildren. God bless America & our Constitutional Right to bear arms!

I think you are silly. She had a lot of luck or the devil wanted that guy's soul. What if he had taken her to the living room or knocked her out? Some details of her story seem fishy. I still wonder if her and hubby decided to get revenge and kill a burglar. Most rapists and serial killers stalk their victims. By the time that they kill or rape their intended victims, they make sure that everything is according to plan. Most serial deadly rapists get caught after they have committed numerous rapes. If you use deadly force, they will use deadly force and catch you unaware. Tell me, Peggy, there are no scumbags in your family? We need more education to help people not commit crimes but get better jobs.

The dispatcher is only trying to get the information together for the responders safety and the lady's safety...If a gun is involved they need to know if the weapon is secured prior to entering the residence. If for example the caller was waiting for the police to arrive and had the gun in her hand the police could conclude that she was the bad guy and possibley shoot her my mistake. You need to remember the police entering a residence do not KNOW what just happened and who the actors are....

She was justified in her actions. I feel that it should be federal law that you can kill an intruder and not be charged with a crime. If a law abiding citizen feels under threat, they can use deadly force. End of discussion. Doesn't matter if they have a weapon or not. If someone goes into someone's house with out permission of the home owner, they forfeit their right to life plain and simple. For that matter, if someone sets foot on someone's property (even outsided of the house) and the resident tells them to leave and they don't, the deadly force is justified. All states of the union must adapt this mind set and maybe we will all be safer.

I couldn't agree more. I especially hate the stipulations that many of these laws have to prevent you from shooting an intruder as they try to flee. In my opinion, they knew the risks when they broke in, they don't get to have a sudden change of heart and run away just to ruin someone elses life. This woman did what any homeowner should do.

That's a little dangerous as far as shooting them when they're outside your home; for one how will you prove you told them to leave? What if they're deaf or mentally challenged and don't understand? Before you laugh, it happens quite often that mentally challenged or Alzheimer's patients wander off. I'm all for defending your life with deadly force; I think it is your duty as a citizen to do such. But to be able to shoot someone who may be 500 feet away from inside your house who, according to your comment may not even be intending you any harm, is insane. I think that the way the law is now is fine; you have the right to use deadly force to protect yourself or a third party from someone who is intending to cause either of you serious physical harm or death. (I'm paraphrasing of course.) It doesn't specify where you have to be in order to do that. Let's not get carried away with shooting people. You tell them to leave and they don't leave; have them arrested. They threaten violence or attempt to harm you then shoot them. As far as shooting them in the back, I say if they've entered your home while you're there then you have to assume they have plans for you. What if they're walking away because they dropped their gun or knife? They break in, deadly force should be justified. As far as the sarcastic comments toward the police, they're immature. You have to understand that the police have to investigate every crime. A grand jur decides if they will be prosecuted.

Steve, The state of South Carolina says that if someone comes onto your property and that if you have a no tresspassing or posted sign then you can use deadly force to to protect yourself or property. The law does state to try to get them to stop until the laqw gets to you but if that is no option then use force. Also in S.C. you can carry concealed in your vehicle in a compartment that was factory installed. The key words there are ( factory installed). If you want to carry off your property on your person then you have to have hand gun training and a liscense.

“Stuff” is replaceable, a life is not. Treading on your grass, is even less reason to destroy lives, yours and their next of kins’.

Overwhelmingly when the police arrive, the danger they were called for is over, and the area is safe and secure by they roll up. Look at the Gabby Giffords shooting for example.
Research it for yourself: Law enforcement officers HAVE NO DUTY TO PROTECT INDIVIDUALS. (Emphasis, not shouting.)
The main job of law enforcement is to generate revenue for the Government (City, County, State or Federal), and write incident reports after the crime is over for insurance companies.
Everyone should ask themselves this: Why should a cop risk his life, to save something so insignificant (your life or the lives of your loved ones), that even the owner is unwilling to protect it?

Police may not be there when everything happens, but by them showing up and conducting investigations they arrest thousands of criminals a year that would be free to commit more crimes. You really have no idea how the police do their job and it's obvious. That's not an insult, but you really should be more respectful of things you don't understand before you make judgements. Are the police to blame because they get called 2 minutes after someone was shot and it takes them 5 minutes to get there? In 2010 only 64 officers died in the line of duty.
I seem to have missed what your statement has to do with the subject

Where do the police have a 5 minute response time? Doesn’t logic and reason suggest that if the police NEED a gun when they eventually arrive “on scene”, the victims responsible for the call in the first place, needed guns as well?

Look at Virginia Tech, most of the 32 victims were murdered AFTER the police were “on scene”. The same for Columbine, where the police TRAPPED the children WITH the murderers.

@ Wildfire There were 158 officers killed in the line of duty last year and 72 so far this year. http://www.odmp.org/search. As far as the obligation, that's to protect them against criminal prosecution in case they don't respond appropriately. They can still be held accountable in civil court if they don't respond appropriately. Officers have been sued successfully for inaction. (Tracy Thurman sued her local police department in the 80's and won almost three million dollars. I refer to that one bc I just saw her movie again on television.) You still don't get the role of police, do you? The reason they write reports is to investigate crimes and to make arrests. Fines from traffic tickets is a convience issue. In the 70's, you went to jail if you got stopped for speeding or other traffic violations. Now you can pay a fine if you have license. People have the option to do time in jail in lieu of paying a fine. Fines are the only way short of sending them to jail to punish them. Yes, it does generate revenue but the police don't benefit from it. But that is not their main job, just the same as the main goal of the fire department isn't to put out fires. The main job of the police is to protect the public; that doesn't mean that they can park in everyone's driveway and catch every criminal and solve every crime. Most police are pro-gun ownership by law abiding citizens to protect themselves. It must be tough on you to know everything, though.

good job girl. too bad here in NC we have to keep our guns locked in a safe when kids live in your house. Too many idiots have guns and don't educate their children about th'em and about the dangers of guns, so of course if you don't teach kids about guns, and you hide them from the kids, the more intrigued they get when they happen upon a gun. this is dangerous, people educate your children about guns so stupid laws like NC has won't be needed to prevent accidents. I just hope if someone breaks into my house while my wife is home, they'll allow her time to get her gun out of the safe before the try to kill her infront of my kids. Some Politicians are STUPID!

To KReid: Having to keep a gun in a safe is a foolish idea.
If this woman had done that, she'd have been raped and/or killed.
The same applies to keeping unloaded guns or having trigger locks.
In an emergency, you don't have time to mess with that stuff.

Teaching children about the use and dangers of guns is the best way to go.
I'm 57 yo and grew up around guns.
Both my father and grandfather kept their guns and ammunition in unlocked gun cabinets.
I don't recall any formal training, but as a kid, the unwritten rule is that you didn't touch the guns without adult permission and supervision.

I bought my own shotgun at age 12 and rifle at age 14.
I kept them and the ammo together in my bedroom.
There were never any "incidents".

We lived in a rural area and every household had guns.
There were never any break-ins or assaults in homes. (Front doors, porches, or driveways....., maybe.)
The official laws on the use of deadly force were rigid, but sometimes ignored.
The general practice was to stay friendly with the local guy who owned a backhoe.

Kudos to the woman who had the good sense to keep a loaded 22 in her bedroom. This was obviously an intentional act of planning ahead for self defense.

Amendment II ....the right of the people to keep and bear Arms, shall not be infringed.

With the exception of convicted felons and the mentally handicapped, every citizen should own and know how to use a firearm for self protection.

I sincerely pray this woman is able to quickly move past the trauma of the event.

This is exactly what Ted Nugent was trying to explain to that Pierce Lame Brain on his show. In communities where the citizens are armed, crime goes down, not up. Until we put real teeth into American criminal law, we need to protect ourselves. My advice to the woman, buy something a bit more potent, like a Glock or a Walther PPK 9mm. She's lucky that she managed to kill him with a .22 pistol.

She was extremely fortunate to have the presence of mind and to actually be able to get to the gun! I have been held up twice - face-to-face - and there is no way I could have gottten to a gun. I believe that people who know how to use them should have them to protect themselves. I've heard people say, "If it happened to me, this is what I would do, blah, blah, blah..." You don't know until you've lived it.

Very true and that is why one needs to take classes and uses the firing range often.
Good job, I know too how bad you feel being placed in a situation where you had to take a scum bag's life. I agree with 99% of the other posters on this situation. You did the right thing by protecting yourself. I read above when seconds count, the police are only minutes away. That is the problem my friends, they are never there when seconds count. They may catch a perp exiting a crime scene, but it is almost always too late for the victim. I feel fortunate to live in a state with a carry law. I carry mine with me everywhere I go, as long as it is permitted in the places I visit. I too, suggest you get a larger caliber gun. a .32 or .380 caliber are big enough for self protection, but you just can't stop a criminal on the spot unless you do as this brave lady did and shoot as them as many times as you have bullets in your gun. I carry a .380 or 9mm and both are loaded with hollow point ammunition. I have also attended classes and shoot at a firing range at least an hour a week. Be smart and protect yourself and never let the government take away your right to protect yourself.

Roger that Sheila. When I had a gun stuck in my face the only thing on my mind was hoping he didn't get trigger happy while I gave him my money. Out and around I do not carry a firearm cause you can be within 1000 feet of a school and not know it or want to go into a business that posts a sign saying "No firearms allowed". If threatened with a gun, they can have my money. If attacked with some other weapon, I carry a cane and have had training using it as a weapon. If someone started shooting at me I probably wouldn't be able to get to my gun in time cause my cane is in my gun hand. At home, it's another story. I have several firearms stashed around my home and can get to them fast enough. I say several; .22, .32, .38, .357, 9mm, all loaded and ready to start pulling the trigger. BTW, they are not locked up cause my kids are grown so no kids in my home.

Has anyone sent this to the American Rifleman? They have a section about people who defend themselves. On another note, has anyone looked at the Taurus "Judge"? The 'Judge fires either a .45 Colt(not ACP) or a .410 shotgun shell. The newest one takes a 410 3" Magnum. This could be a great self defense weapon due to the fact that a shotgun round won't go through the walls to the next door neighbor.

SHE is a survivor and thankfully will do so without the bullsh*t thats attached to surviving after an attack like that is completed. To those who commented that guns are not the answer.Keep in mind that through out our history our forefathers kept guns in the house, they were a part of daily life just as an axe and a mule were. Kids grew up learning to use them and most importantly to respect them. Try finding cases in our 1700 and 1800's history in which someone was accidently shot with a gun and you will find almost none.

The problem occurs with the person who purchases a gun on a whim with no exsperience with it. As for this woman's actions I applaud and congradulate her. She did exactly what she should have done. Her only mistake was using such a small caliber weapon.

A bunch of small caliber holes make up for the lack of a larger caliber. A .22 caliber is a high velocity round that will go right thru a person unless it hits a bone then it just bounces around inside them.

I've been through some pretty hectic situations, and think this woman showed a great deal of presence of mind. a panic stricken person is more likely to make fatal mistakes. For all those readers out there, it is a scary world, and it's a good idea to have some training, just in case. maybe the police won't show up in time, and you'll have to save yourself, who knows? always good to prepare for anything. I'm the best shot in my family, both my kids have passed their hunters safety course, and we're all honest about social violence rising when times are lean. We don't constantly worry about violence, we're pretty confident we can handle what comes our way. plus, we're aware enough to recognize worry, panic, negative emotional responses in general are secondary to fear. You overcome fear by learning to trust yourself in this big, genuinely scary world. Hats off to this woman, hopefully I'd be sharp enough to handle myself the same. I'd be using a hotter round, for sure, but go with what you know, she did well.

Your decision to shoot as many times as possible was a very wise, good, decision. The rule of thumb, keep shooting until the criminal stops moving then shoot one more time for your safety. As for the .22 caliber, my guess is she probably bought a .22 because she was advised by seller that it was low recoil and low blast noise and light weight. A .22 can be deadly with the right ammo and or good aim ( read Israeli Mossad assassination ) but not advisable in an extreme emergency. So, For all you gals who want to defend yourself, TAKE THE ADVICE ALREADY OFFERED: GO TO A GUN RANGE AND TRY OUT DIFFERENT WEAPONS. And if you can, try firing on an open range somewhere. GUNS MAKE VERY LOUD NOISES. DON'T buy a revolver. Semi-automatics like Glock etc carry more bullets. THEN PRACTICE, PRACTICE PRACTICE, so you can hit what you are shooting at and the noise doesn't distract you.

Lesson to us ALL .Make sure your home is NOT that easy to break into. I prevented 4 teens from breaking into my vacant rental,withthe common chain lock $3. By using 4-5 inch screws,not the 1/2 inch supplied.After they destroyed the door and window in the door,not until then did the chain do its job.After spending all that time, they finally gave up after the neighbors heard them slamming there weight into the door,the 4 inch screws were pulled out only 1/2 depth. Put bars on ONLY the window they would choose to break through. I put Bars ON that window AFTER they broke in,I knew I was putting that job off. Make your home difficult enough to break into ,that they dont try or give up after no success. This labor can save you so much pain. If you have a gun LEARN HOW to use it.There is NO LAW in the ARENA,no laws will protect you, acquire what it takes to protect yourself.

My prayers go out to the victim that has to live with the knowledge that she took a human life. Though I have never had to myself (and hope never have to) I understand that it is a difficult burden to bear even when the person you've killed left you no choice. As for the perp, he 's paid in full for the crime he committed so it's okay to pray for him as well. After all, God loves him too. One can only hope, other d**kheads like that will take note and think twice before they try and assault a "weak" victim. With respect to the ladies choice of weapon here, all the story said was that she had a .22 cal. If it was just a .22lr than she is indeed lucky that she hit him where she did as the round typically will just "poke holes" at close range. A .22 Mag with jacketed hollow point bullets however, can deliver a substantial amount of energy and lethality at close range (10-15ft). My Pap, who was a skilled gunsmith as well as an expert marksmen, figured that out when trying to find a pistol/caliber/load combination that would work for my Ma. While most Men prefer a large caliber for obvious reasons ( I am partial to the .41 Rem. Mag. myself), many women are not as comfortable handling that kind of horse power. And remember the key, as it was in this case, was hitting the target where it mattered, when it mattered. I would recommend that every woman arm herself with something that she is comfortable shooting and that she practice until she can operate it and hit what she aims at without thinking

My sister had this happen to her; she didn't even get the gun out of the holster but she managed to get her finger on the trigger and pointed that baby in her attachers face. Jake, I disagree with you on the statement about not buying a revolver. Any semi-automatic requires a round beiing put in the barrel and taking it off SAFETY. Most folks in a non-thinking situation of life or death WILL NOT remember to do those things, especially if they are not really familiar and proficient with a handgun. Therefore I recommend a revolver, if it is loaded all you have to do is POINT AND PULL TRIGGER to shoot! I keep the cylinder under the hammer empty for safety sake.

Any semi auto has to be taken off safety? A Glock only has a trigger safety which is disengaged when you pull the trigger. As far as requiring one in the chamber, well that's why you charge it before you put it down. I'll take 16 .40 caliber rounds and the ability to reload in less than a second over your six rounds and who knows how long to reload. Yes, one well placed shot is all you need but I'd rather have the extra rounds just in case. What if they enter your home well armed and a gunfight ensues? Always be prepared for a worst case scenario. I have two Glocks, a Beretta 9mm and an H and K .40. The H and K has a safety but you have to put it on safety. You can leave it on fire and never use the safety. I also have a Colt .38 revolver which is in my closet; the H and K is under my pillow.

I'm liberal, I have a conceal carry permit, and I am thrilled this lady had the ability to think, react and act quickly in such a dire situation. My only concern is for her mental well being, as I hope she does not waste one moment of her life worrying about taking this beast's life. Had he escaped, he would have attacked another person almost immediately. Had he lived and been incarcerated, he would have learned that speaking victims put you in jail, and he would be better prepared once parolled. Sadly, sexual predators really are not capable of rehabilitation. This is not a random thought or knee jerk reaction. It is based on knowledge and experience working within the Virginia criminal justice system.

I live in Indiana and usually always carry a 45 Auto, but sometimes a 9mm or even sometimes both since i do have a carrying permit. And since you do not have to have it covered up (Legally Speaking) I don't always want to wear a "trench coat" to cover them, and one of my best friends asked me "why do you carry two guns" "are you Scared" and i naturally said "No i'm just PREPARED". And I do agree that the best reason to carry a gun is because a cop is too heavy.

Best thing she could of used, especially if she got off more than one shot to the rib cage .Having worked on a resue squad, had an emergency room doctor tell me it is probably the deadly's gun out there!! A 22 has enough power to penetrate the rib cage, but not enough power to exit. It just rickoshays in the rib cage until it runs out of speed or lodges in a bone usually cutting main artery's, lung's ,esophogus, heart !! Victim usually doesn't die imeddately, but almost always dies{due to all the holes in major organs}. Victims of 22 shooting usually complain of being on fire and if possible seek out cold running water, to put out the fire they are expersing. I hope he had enough time to reflect on his intention's for his chossen victim, and realized the meniscule heat he was suffering was nothing compared to the eternity of heat he will suffer in Hell. I truly feel sorry for this women having to live with the experience of knowing she had too take someone's life and future. How many other victims did she save?? No one will ever know. I personally am praying for her, that she may overcome this unwanted tradegy. May God bless her, heal her mentally and physically , grant her a long healthy and happy life. I'm proud of her the life she took may have saved your's, a loved one, or mine!!!

Best thing she could have used? It did the job, yes, but he had ample time to kill her if he was determined enough. It worked, but I would suggest something with stopping power, not wounding power to give them time to reflect on what they've done. I want them to be thinking "Oh sh--" and that's the last thing they think. Six .40 rounds in the chest and they won't be able to do much at all. He gets pissed after you've shot him with a .22 he may be decided to kill you before he dies. Luckily this guy just tried to get away.

I should add the arrest six months prior was for posession of a handgun by a felon, possession of burglary tools and two others. That occurred in the Gwinnett County area. I do not know re. Nebraske but most terroristic threats are misdemeanors, eg. CO, TX, PA. Possibly threatened w/a gun, knife, etc. but I am completely guessing. BTW, terroristic threat has nothing to do with Al Queda!

Ray, Puentes was/is a African-American. He called himself "Black" on previous arrest reports. Today it is getting much harder to profile someone by name alone. Many Muslim names turn out to be American born African-Americans. Many Mexican sounding names the individuals do not appear "Mexican" at all. I am happy for her outcome, and that no charges will be posted against her. My wife was verbally abused and beaten up by her brother and father inside our house while protecting her ill mother from them . She went into our bedroom retrieved a gun and told them to leave. When she went outside to help her mother into the truck they beat her up again, took the gun away and called the police. The Police never asked her why she pulled a gun on them, but rather only took statements from her father and brother. Guess what they said! She was jailed and had to pay several thousand dollars for bail, lawyers fees, and getting her name cleared for family violence. The judge never asked to see the photos and doctors exam records revealing her injuries from the beating . Antonio Tx.

Interesting story, but we're only hearing it third party; With two witnesses against her, it will be tough to side with her. I have faith enough in the judicial system that the right decision was made. Not only by the police, but the prosecutor's office, judge and probably a jury. I am glad that she was able to get to her pistol. A larger caliber would have been better, but hers got the job done. The shower or tub is a vunerable place to be for anyone. I carry a Glock, but it isn't in the bathroom when I shower so I depend on my dog to warn me. I wish that stories like this would make the news. The shooter's name and address wouldn't have to be used to protect them from the perpertrator's friends or family.

As a retired Peace Officer, I've been through a few "surprises" myself, nothing like this brave lady, but the surprises came just the same. After two tours in Vietnam, killing someone that's trying to do you in is almost second nature. She did the right thing and probably saved others from the same intention this dirt bag had in mind.

The AK47 is not a good home defense weapon. The only long gun I would recommend for that is a shotgun. At the ranges you would use it in the average home you could use birdshot and you wouldn't have to worry about it going thru the wall and killing someone in the next apartment.

I knew an Army Seargent one time who was in charge of the soldiers on sentry duty. The policy at the time was if there was an intruder; you must tell him/her to Halt, if the intruder did not obey you must fire a warning shot before actually shooting to kill or injure. The seargent told his sentries that if they had to fire be sure to fire two rounds, then no one knows which one was the warning shot and the timing of the warning was flexible.

Good job lady: I wanted to ad that many years ago, as a young Law Enforcement Officer, I would come home and place my weapon on the top shelf in the closet. My 3 young kid were aware of it. None of them ever touched the weapon. I took them to the range when they were young an let them fire the weapon. ( 357 mag). All 3 grew up to be Law Enforcement Officers. I am so proud.

At one time in man's history members of a tribe who did something negative (not conducive the tribe's survival) were forced out of the cave, hut or village. These individuals did not survive (and procreate) more often than not I suspect. Over time we became better humans as those genes were removed from the population pool. My NRA instructor told me I don't have to worry about flinching because I don't and I would not like to shoot someone but if I had too I would and the cops in my neck of the woods know that I am armed and told me I should be. They also know that I will shoot if I have too and that I don't want too but will if it comes down to it. I think god was with you and gave you the presence of mind to do what you needed too. I believe everyone should be armed. If they take our guns get a cross bow. Learn to shoot a shot gun and you got it covered. I will keep you in my prayers and ask for you to be at peace.

But a lot of you folks need to understand that the odds are much greater that a gun in the house will be used AGAINST the resident. No gun should be where any child can reach it, and adults, when going for their guns to protect themselves, have to have the "KILL" mindset. Too often, the victim hesitates, either out of fear or hesitance to hurt or kill another human being, and then loses control of the situation, which can then lead to losing the gun, and then one's life (and/or others' lives). - Just being proud of owning a gun, and a macho attitude like that expressed by many people here, can, overall, do more harm than good! It's very possible that you might be safer without a gun than with one.

Kudos to this woman for defending herself. She really should consider a 9mm as it has more stopping power - but my wife prefers the .22 also for its accuracy. She can knock a fly off your shoulder at 30 feet with her .22 Walther. I use the 45, which is much less accurate, but all you have to do it hit once and you are good. The 9mm is a good compromise for accuracy and stopping force.

Miner Injury's? May be this is her version of the story. This whole scenario could have been fabricated. Maybe this was someone who scorned her so she decided to shoot him. Maybe because he was hispanic and because of the sterotypes that are out there she knew people would easily believe her story. I happen to think it's strange that she didn't call the police from her home after she LOCKED him out when he ran out the door. She ran out the door where the INTRUDER WAS to call the police. I live in Alabama and we also have a "castle law" which pretty much covers a homeowner in a situation such as this. This is a perfect example as to why Guns should be Outlawed. There are too many people being killed with guns when a simple conversation could solve any problem. Glad this lady could protect herself-- wish others could--I'm a NRA certified firearm instructor ( with carry permit) and teach one on one hand gun "safety & use classes" for free to anyone I know as my time alows . I keep loaded guns in my home / auto some locked up ,some unlocked all in easy reach. My children have been taught how to shoot and know what shooting something means ! They have never touched any type if firearm in the house including BB guns without asking permission, but know they can in an emergency. The only gun control we really need is the gun owner using their local range to become good at shooting their firearm. EVERY homeowner should be prepared to defend themselves and their family from street trash looking to do harm to others.

In Breat Britian and most EU countries she would be charged with murder and multiple firearms offences. That's where this nation is headed.
Gun control advocates will take incremental "sensible" steps to disarm the US population. The US is one of the last bastions of private, legal firearms ownership in the world.
Events like this, where an innocent person protected her life with a firearm, mean nothing to these people and will not change the opinions gun control advocates. They will get your guns one way or another.

I am a 73 yr old widow.. I have a 32 on top of the fridge, a 22 in the cabinet and a 38 in the nightstand by my bed. Also, an elaborate alarm system and a fifty lb dog.. BRING it on rapists, thugs, dopeheads.. MAKE MY DAY. I am right on with this lady.. I do think it was too simple for this thug to enter her home.. She needs a security system..and motion lights.....I am so glad she was able to get to her gun.. Just wish she could have shot him more and with higher caliber.. And also to the idiot who brought race into this issue, I believe the intruder was Hispanic not black.. Anyway, what difference did it make whether his ding-dong was black, brown or white. He was going to rape her for sure and probably kill her.. I am glad the SOB is dead.........

I agree with you, GOOD FOR HER. No charges filed against, I sure HOPE NOT. As for the dispatcher, I guess she is told to keep people on the phone until the cops arrive (which would have been too late) and talk about the weather if they have to. Their cold callous voices and nonsensicile jibbership bewilders me sometimes.

But the sad fact is that for every story like this there are 50 stories about family members being shot and killed - either accidentally or intentionally. I often encounter emotional gun control people who beleive that guns are the problem and not the solution. I have found a great tool for those willing to read. It is a book called More Guns Less Crime by John R. Lott, Jr., he was a professor of economics at the University of Chicago when he wrote it. GO FIGURE. For any one who believes in logic this is the book to have!!!!

To the woman who shot the intruder. YOU DID RIGHT!!! You were protecting yourself, and it was the right thing to do, and don't let anyone tell you different. As far as people saying it should have been a bigger caliber, remember this. It's not the size of the gun, it's how comfortable you feel with it and the job it does. In this case the .22 was enough gun to get the job done which was to get the attacker off and away from her. In my home I keep at least 3 loaded guns. I'm usaully within a couple of feet from one anywhere in the house.

This is a great example of a DEAD offender versus a REPEAT offender.
Gun control and drug control are the same. When there are no more criminals using drugs, perhaps then there will also be a way to effectively keep guns away from the criminals as well. So far, NOT WORKING. I'LL KEEP MY GUNS AS LONG AS THERE ARE CRIMINALS WHO NEED TO BE SHOT.

For all of you saying that she was lucky to have killed him with a .22 calibur gun, think about it this way - it apparently took awhile for this idiot to die (can't believe I am talking like this), so he obviously had time to think about what he had done and know that he was paying the ultimate price for his crime. Good Job ! For 40 years now Fairfax County VA - one of the largest in the USA has had a policy of prosecuting the homeowner in every instance of home defense. Under one or another statutes they always bring charges and never get a conviction. This is usually a very expensive proposition for the homeowner who defended his property or life. The Police advise shoot to kill - leave no witness - nor anyone maimed. This advice is always off the record. Look into a gun safe for a pistol that opens with a fingerprint reader - opens in seconds and still meets the lock up thy firearm law.

I'm a Massachusetts Liberal Progressive with a house full of guns(Heavily Armed Liberal) some loaded and ready to defend myself and my family and also a permit to carry loaded and concealed..
I do everything legaly and safely in the most restrictive state in the union.
It's not difficult, just right.
My guns are controlled, they should be, they are dangerous, they are killing machines.
I hit what I'm shooting at and practice regularly at a range.
I would never want to hit something I was not shooting at, and I would never want to miss something that needed to be shot.

I was born and bred in Mass.. I left. I hope you never have to shoot an intruder and get charged with murder if he dies, 'assault with inten' if he doesn't . You will go in front of a judge who will tell you that the "back to the wall doctrine applies" and because you did not go into the cellar or backyard to get away in hopes that the intruder has left you are guilty of murder. Meanwhile the poor person you shot or his family sues you for committing a criminal act.

I had goosebumps listening to her; goodness I hope she'll be ok, I mean how do you feel safe in your home again? Thank you for saving yourself and others from this man. We have always had guns in our house and our kids were trained from the beginning that they were not toys. Once our neighbor and his brother told my husband that they were coming over to beat him up, because their vicious dog had disappeared and they thought he had killed it.This dog had terrorized our family to the point that we couldn't leave the house to feed our horses. When called, the neighbor wouldn't come get his dog. One of the other neighbors got tired of it trying to attack his children and it disappeared. The cops wouldn't do anything. They told us to shoot the dog. My husband called the Sheriff and they said they didn't have an Deputy to send our way, but they would file a report if something happened. My husband said he wasn't going to take a beating for anyone, but that if they had no one to send that it was no longer an emergency, that if they would not protect us, he would save them the trouble and that they could just send the coroner. Needless to say, the Sherriff was there in 10 minutes and was waiting for the 2 bat wielding idiots when they arrived. Some people live hours from police assistance and they need to protect themselves. The police have no obligation to get to you even if you live right next door to the precinct. If you own a gun, learn to use it and take care of it. Become comfortable with it and don't leave it where the barrel can become fouled with foreign objects.

You play.....you pay.....the scumbag recieved his just dessert for his crime, God bless the female doing what she had to do to survive and to see another beautiful day on this earth.Now you can fully understand why it is law that you have to have a weapon in your home in kennesaw,That was the best law i have seen.I live din kennesaw for 2 yrs and the first week after moving into my new house a male subject under the influence of PCP was terrorizing the neighborhood running around naked , covered with blood from head to toe in the middle of the night luckily myself and a cobb county officer intercided and took this sub down before he could do some serious damage,but imagine in his state of mind what could have happened.I live in orlando fla now and a retired law enforcement officer and it is no better here. But again this had a positive turn out and god bless the lady who thought quickly and truly will make a difference

I just looked at the video. I'm not sure about this one. Did he shoot one of the guys outside the store? If so, maybe that wasn't right. And he just walked over and shot the other guy, who you couldn't see but apparently laying on the floor. If he had shot them when they first came in pointing a gun at him, I would have had no problem with him shooting them. I don't think he should be charged with murder, but I'm not sure he should be completely exonerated.

It's Sunday, and as I am getting ready for church, the facts in this article bother me. Either this woman was really lucky or the devil wanted this man's soul before he repented. What if he knocked her out or led her to living room? Her butt would have been done for then. I hope the police did their job and investigated this to verify all the facts. It's just too clean. How do we know if she decided to seek revenge on a burglar? Where was her husband? He appeared by magic after the act to try to cover her up with a towel. "She" shot the perp nine times or was it her husband? Crime scenes may be staged. Oh, by the way, the cops said that they were looking for other victims, but it was not known to be any at this moment. One way to stop burglars and theft is education and get harsh on the selling of illegal drugs.

To the lady that pulled the trigger, please do not victimize yourself by thinking about killing a person. He lost the right to consideration when he violated your right to be secure in your home. He had a choice.
Further on the subject, “Gun control” should mean that your hand does not shake and scatter bullets around the room. Learn how to use your weapon. Keep the bullets on target and empty the gun into the perp.
Just the presence of the STRANGER in YOUR house should be sufficient to justify defensive action. Whose fault is it anyway if the low life picked the wrong house to victimize. It takes a second to save your life it may take years to go through the legal process of explaining why you had to take the law in your hands. Of course we should think about the low life that tried to violate your rights. Any such law suits by the victims relatives should be barred. Criminals should understand it is criminal to violate another's person and premises. If they do, they are subject to death at the hands of the law abiding resident of the house the criminal attempted to violate. People should not be defenseless in their own homes. If criminals think that EVERY HOUSE might have an ARMED, TRAINED OCCUPANT, the criminals might choose another lifestyle. EDUCATE children at the root. They will not grow up to be criminals. Entitlement is not the answer. Teach children to be responsible and to EARN THEIR REWARDS. The "reward" for violating a woman against her will is death!

My hat is off to you. I have this feeling you are a good woman, a woman any man would be proud to be with, any child proud to have as a parent, any community proud to have a a member. As such I believe I'll only make two suggestions: You actually don't need a bigger gun, just hotter ammo. Buy twenty-two magnum, hollow points--that'll "get er dun" and do something for him he wouldn't have done for you. Pray for his eternal soul. You did what you had to do. Now it's up to Our Loving God to sort out the one's He wishes to keep from those He doesn't. He should thank you for the free ticket home. And, you sent him "first class". That's better then INS would've done either in hie previous journey's or future one's--of which, for him, they're will be none. Further, in our time of conserving fuel, look it as doing your part in not having to ship another busload home. I know, they didn't say he was an illegal. If you are going to keep a gun for self-defense, learn gun safety, (2 year old shot himself to death in Ashland, KY today's paper), be completely familiar with its operation and find a place to practice with it. Shoot it as often as you can. If you have a concealed carry permit, give careful thought as to the best and safest way to carry it and practice getting it into action quickly (practice with it unloaded). And once again know everything there is to know about safe gun storage, handling and shooting.
